Terms of Service

Effective Date: December 22, 2025

By accessing or using the services provided by Jardinette Inc. ("Jardinette," "we," "us"), including the website jardinette.ca and our "Find Your Plant Match" application (the "Service"), you agree to be bound by these Terms of Service.

1. Description of Service

Jardinette provides digital tools to assist urban gardeners in matching plants to their environments. The Service is currently provided for informational and planning purposes.

2. User Accounts and Security

• Eligibility: You must be at least 13 years old to use this Service.

• Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials, including accounts accessed via Google OAuth.

• Termination: We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

3. Intellectual Property

• Our Content: All software, algorithms (including the Plant Matcher logic), and branding are the exclusive property of Jardinette Inc.

• User Content: By entering data into our planner, you grant Jardinette a non-exclusive, royalty-free license to use that data in an anonymized, aggregated format to improve our algorithms and environmental research.

4. Future Product Sales

While the Service may describe physical products (e.g., Phase 2 Starter Kits), Jardinette does not currently process payments or conduct direct e-commerce transactions through the Service. These terms will be updated should payment processing be integrated in the future.

5. Limitation of Liability

The Service is provided "as is." Jardinette Inc. does not guarantee that every "Plant Match" will result in a surviving plant, as biological outcomes depend on individual care and external environmental factors. To the maximum extent permitted by law, Jardinette Inc. shall not be liable for any indirect or consequential damages.

6. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada.

7. Modifications

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the new terms.
